Welcome to GarageWODs. These Terms of Use ("Terms") govern your access to and use of the GarageWODs mobile application and website (collectively, the "Service"), operated by GarageWODs ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and not share your password with others.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activities that occur under your account.

We reserve the right to terminate accounts that violate these Terms or for any other reason at our sole discretion.

3. User-Generated Content

The Service allows you to post, share, and interact with content including workouts (WODs), photos, comments, and personal records ("User Content"). By submitting User Content, you:

  • Represent that you own or have the right to share such content.
  • Grant GarageWODs a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service.
  • Understand that other users may view, save, and interact with your publicly posted content.

4. Prohibited Conduct

You agree not to use the Service to:

  • Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • Post content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights.
  • Upload or transmit viruses, malware, or any other malicious code.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service for any commercial solicitation or spam without our written consent.
  • Collect or harvest personal information from other users without their consent.
  • Engage in any conduct that restricts or inhibits others from using or enjoying the Service.

5. Health & Fitness Disclaimer

The workouts, fitness programs, and health-related content available on GarageWODs are provided for informational and community purposes only. This content does not constitute professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any new exercise program. GarageWODs is not responsible for any injury, illness, or adverse health outcome resulting from use of information or content found on the Service.

6. Intellectual Property

The GarageWODs name, logo, app design, and all original content created by us are the exclusive property of GarageWODs and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our proprietary content without our express written permission.

7. In-App Purchases & Subscriptions

The Service may offer in-app purchases or subscription plans. All purchases are processed through Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel subscriptions through your App Store or Google Play account settings. Refunds are subject to the policies of Apple or Google, as applicable.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GARAGEWODS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless GarageWODs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and/or by email. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 5, 6, 8, 9, 10, and 11 survive any termination of these Terms.
